Terms and Conditions for KUB Gem Points

KUB Gem Points are an additional service for Users of Bitkub Exchange, through which Users can earn KUB Gem Points from trading digital assets on the Bitkub Exchange platform. The accumulated KUB Gem Points can be redeemed for rewards. KUB Gem Points are part of the Company’s services and are governed by the User Agreement published on the Bitkub Exchange website, together with the following additional terms and conditions applicable to KUB Gem Points, which form an integral part of the User Agreement.

  1. The Company reserves the right to grant KUB Gem Points (“Points”) only to the User who has the status of Company Customer, as specified under the User Agreement.

  2. The User shall be entitled to earn Points only upon conducting eligible digital asset trading transactions on Bitkub Exchange, in accordance with the criteria, procedures, and conditions prescribed by the Company. The Company reserves the right to amend, modify, supplement, or cancel such criteria, procedures, or conditions from time to time as the Company deems appropriate.

  3. The Company reserves the right to provide the KUB Gem Point accumulation service only to general Users who are not market makers and who have not already received benefits or incentives from other programs or campaigns of the Company, as determined by the Company.

  4. Points do not constitute property and may not be exchanged for cash or transferred to any other person. The sale, transfer, or assignment of Points is strictly prohibited unless otherwise expressly permitted by the Company.

  5. The User may redeem Points only in accordance with the criteria, procedures, and conditions prescribed by the Company.

  6. The User who has sufficient Points may redeem such Points for rewards, including but not limited to products, services, coupons, vouchers, or other assets prepared by Buzzebees Co., Ltd., which is the service provider responsible for Points redemption.
    • For the avoidance of doubt, any rewards, products, coupons, vouchers, or other assets that the User may redeem are not properties of the Company but are the properties of Buzzebees Co., Ltd. or its business partners who have authorized Buzzebees Co., Ltd. to manage and offer such property as redeemable rewards under campaigns or activities designated by the Company. The Company is not a seller, distributor, or provider of any such rewards and has no involvement in the products or services offered for redemption. Accordingly, the Company shall not be responsible or liable for any matter arising from or in connection with the redemption of such rewards.

  7. The redemption of Points shall be limited to the rewards that are available for redemption and subject to the applicable period, quantity of rewards, membership level (tier) of the User, and/or the maximum daily redemption limit as prescribed. The User acknowledges that the rewards available for redemption with Points are limited only to such products, services, coupons, or other assets as determined or made available by Buzzebees Co., Ltd. Therefore, the rewards for redemption may be changed at any time.

  8. Once the User has successfully redeemed Points for a reward, such Points shall be used for the redemption, and the User shall not be entitled to make any changes to or cancellations of such transaction. In the event that the transaction is cancelled for any reason whatsoever, the redeemed Points shall not be refunded, unless the cancellation results from a defect or error of the system providing the service, or as otherwise provided under the Company’s terms and conditions.

  9. In the event that the User’s account is suspended or terminated, whether temporarily or permanently, in whole or in part, and for any reason whatsoever, the Company shall have the right, in accordance with the User Agreement, to suspend or cancel the Points, refuse the redemption of Points, revoke any Points or other benefits (if any), or require the User to be liable for other matters as permitted under applicable law.

  10. In the event that the User redeems Points for a reward in the form of an e-Coupon, but fails to use such e-Coupon within the specified conditions or validity period, for any reason whatsoever, it shall be deemed that the User has waived the right to receive such reward. The User shall have no right to request a refund of Points, request conversion into cash, or claim any damages from the Company in any respect.

  11. If the User’s account on Bitkub Exchange is terminated or the Company terminates the provision of its services to the User, for any reason whatsoever, and the User subsequently registers for a new account, all information relating to Points, including accumulated Points, membership level, and other related details, shall be regarded as new account information. The User shall have no right to claim or request restoration of any membership level, accumulated Points, or other details from the previous account.

  12. The User acknowledges that the platform for Point redemption services is operated, managed, and administered by Buzzebees Co., Ltd.. The Company only prescribes the criteria, conditions, and rules for Point redemption to receive rewards on such platform. Accordingly, the Company shall not be liable or responsible, whether directly or indirectly, for the availability, performance, or quality of any Third-Party Services, or for any damages or losses (including loss of data) arising from or resulting from the services of such third party.

  13. The User agrees and consents that the Company may modify, suspend, or terminate the KUB Gem Points service as the Company deems appropriate. The Company shall make an announcement or provide prior notice to the User in advance. The User acknowledges and agrees that, upon termination of the KUB Gem Points service, all Points of the User shall be automatically cancelled, and the Company shall not be liable for any damages arising from such termination.

  14. The Company shall have the sole and absolute right and discretion to determine, amend, modify, suspend, or cancel any qualifications, criteria, methods, rules, and conditions relating to Points, including the calculation, accumulation, redemption, and use of Points, as well as the redemption of rewards, as the Company deems appropriate, without prior notice. The Company shall make an announcement through its communication channels accordingly.

  15. The User acknowledges that the Company collects, uses, and discloses (collectively, “Process” or “Processing”) the User’s personal data for the purposes of operating and administering Points, and that the User’s personal data may be transferred to Buzzebees Co., Ltd., the platform service provider for Points redemption. Details of the Processing of the User’s personal data by the Company are set out in the Company’s Privacy Notice published on the Company’s website. The platform service provider may also process the User’s personal data for its own purposes. In this regard, the Company recommends that the User review the platform provider’s privacy policy of Buzzebees Co., Ltd. available at https://crm.buzzebees.com/en-th/privacy-policy/.

  16. The Company has no involvement with the products or services offered for redemption. All products are managed and delivered by Buzzebees Co., Ltd.
